FBR constitutes committee to formulate rules under modified section of Customs Act

Federal Board of Revenue (FBR) has constituted a committee of senior officers at Customs House, Karachi to formulate rules to implement section 156(1) of the Customs Act, 1969 as modified by the Federal Government vide Finance Act, 2021.  The said provision of law prescribes certain penalties for not placing invoice, packing list inside the container or failure to attach or upload mandatory documents with the goods declaration (GD).

The committee will formulate rules to develop parameters to specify the person and circumstances in which the penalty prescribed for non-placement of invoice and packing list shall be imposed. The committee will also identity different types of GDs and prescribe documents that are considered mandatory for submission along with those GDs.

FBR has explained that the rules will be notified in due course of time and till framing of rules, no action shall be taken in this matter. FBR has assured the trade bodies that the subject provisions will be applicable only after notification of rules by FBR. Meanwhile the earlier practice will be continued by the Customs field formations. Moreover, after submission of draft rules by the committee, FBR will publish these draft rules on the FBR website for seeking input from all stakeholders before implementing the same.

فیڈرل بورڈ آف ریونیو نے کسٹمز ہاؤس کراچی کے سینیئر افسران پر مشتمل کمیٹی تشکیل دے دی ہے جو کہ فنانس ایکٹ 2021 کے تحت کسٹمز ایکٹ 1969 کی ترمیم شدہ شق پر عمل درآمد کے لئے قوانین مرتب کرے گی۔ قانون کی مذکورہ شق گڈز ڈیکلیریشن  کے ساتھ لازمی کاغذات منسلک نہ کرنے  اور کنٹینر کے اندر پیکنگ لسٹ اور انوائس نہ رکھے جانے کے خلاف سزا تجویز کرتی ہے۔

کمیٹی قوانین مرتب کرے گی اور انوائس اور پیکنگ لسٹ نہ ہونے پر تجویز کردہ سزا کو متعین کرے گی۔ کمیٹی مختلف اقسام کے گڈز ڈیکلریشن کی نشاندہی کرے گی اور گڈز ڈیکلیریشن کے ساتھ ضروری کاغذات کو منسلک کرنے کی بھی نشاندہی کرے گی۔

ایف بی آر نے وضاحت کی ہے کہ قوانین جلد مرتب کر لئے جائیں گے اور جب تک قوانین مرتب نہیں ہوتے کوئی بھی تادیبی کاروائی  نہیں کی جائے گی۔ ایف بی آر نے تاجر تنظیموں کو یقین دہانی کرائی ہے کہ  یہ قانونی شقیں قوانین مرتب ہونے کے بعد ہی قابل عمل ہوں گی۔ کسٹمز فیلڈ فارمیشنز قوانین کے مرتب ہونے تک پرانے طریقے سے معاملات چلائیں گی۔ ایف بی آر نے مزید کہا ہے کہ کمیٹی کی طرف سے قوانین کو مرتب کرنے کے بعد ایف بی آر کی ویب سائٹ پر اپلوڈ کر دی جائے گی تا کہ اس پر عمل درآمد سے پہلے تمام سٹیک ہولڈرز کی آراء حاصل کر لی جائے۔
