FBR approves the Audit Policy 2019

Federal Board of Revenue has approved the Audit Policy, 2019 pertaining to Tax Year 2018. The Audit Policy, 2019 shall apply to persons or classes of persons falling under all or any of the three domestic Federal Tax Statutes i.e. Income Tax Ordinance 2001, Sales Tax Act 1990, and Federal Excise Act 2005.

FBR has added that criteria for selection of cases (for all taxes) for Tax Year 2018 would be parametric. Cases will be selected on scientific approach for which a software has been designed and put in place named as “Risk Based Audit Management System” (RAMS). This will enable FBR to focus on cases with maximum non-compliant taxpayers while facilitating compliant taxpayers and building the confidence of taxpayers in the Audit system.

FBR would shortly conduct computer ballot by applying Risk Based Parameters for selection of  0.76% of cases for audit out of the total filers after exclusions in Income Tax for the Tax Year 2018. For Sales Tax and Federal Excise Duty, the FBR would select 1.67 % and 5.65 % cases for audit respectively out of the total filers after exclusions for tax periods corresponding to accounting period adopted for the purpose of returns of Income Tax, for Tax Year 2018.

In order to facilitate the taxpayers, FBR has approved certain categories of the taxpayers to be excluded from selection i.e. those picked up for investigations by FBR Intelligence & Investigations Wing, all cases where income chargeable to tax under the head salary and /or pension exceeds 50% of taxable income, except cases having business income. Directors of companies do not qualify for this exclusion. All cases where entire income is covered under Final Tax Regime (FTR), all cases where declaration has been made under the Voluntary Declaration of Domestic Assets Act, 2018, all cases where declaration has been made under the Asset Declaration Ordinance, 2019 and Federal, Provincial and Local Government Departments, have also been excluded.

As per law, the Parameters for selection of cases for audit are confidential and hence shall not be disclosed. Balloting on the basis of above policy would be held shortly. The Audit Policy, 2019 pertaining to Tax Year 2018 has also been placed on the website of FBR which can be accessed at www.fbr.gov.pk

ایف بی آرنے آڈٹ پالیسی 2019 کی منظوری دے دی

فیڈرل بورڈ آف ریوینیو نےٹیکس سال 2018کے لئے آڈٹ پالیسی 2019 کی منظوری دے دی ہے۔ آڈٹ پالیسی 2019 کا اطلاق انکم ٹیکس آرڈینینس 2001، سیلز ٹیکس ایکٹ 1990 اور فیڈرل ایکسائز ایکٹ 2005 کے تحت رجسٹرڈ افراد پر ہو گا۔

ٹیکس سال 2018 کے تمام ٹیکسز کے لئے کیسز کے انتخاب کا معیار پیرامیٹرک طریقہ کار پر مبنی ہے۔ سائنسی بنیادوں پر کیسز کے انتخاب کے لئے رسک پر مبنی آڈٹ مینجمنٹ نظام نامی سافٹ ویئر  ڈیزائن کیا گیا ہے۔ اس سافٹ ویئر کی بدولت ایف بی آر کے لئے ممکن ہو گاکہ وہ زیادہ سے زیادہ عدم تعمیل کرنے والے ٹیکس گزاروں کے کیسز پر توجہ دے سکے اور تعمیل کرنے والے ٹیکس گزاروں کو سہولت دے تاکہ ان کا آڈٹ نظام پر اعتماد کو مزید بہتر بنایا جاسکے۔

ایف بی آر نے کہا ہے کہ جلد ہی رسک پر مبنی پیرامیٹرز کے تحت کمپیوٹر قرعہ اندازی کے ذریعے سال 2018 کے انکم ٹیکس کے لئے تمام فائلرز ما سوا وہ جن کو خارج کیا گیا ہے کے 0.76 فیصد کیسز کا آڈٹ کے لئے انتخاب کیا جائے گا۔ اسی طرح ایف بی آر تمام فائلرز میں سے سوائے وہ جن کو خارج کیا گیا ہے ، سلیز ٹیکس اور فیڈرل ایکسائز ڈیوٹی کے لئے باالترتیب 1.67 فیصد اور 5.65 فیصد کیسز کا آڈٹ کے لئے کمپیوٹر قرعہ اندازی کے ذریعے انتخاب کرے گا۔

ٹیکس گزاروں کی سہولت کے لئے ایف بی آر نے انتخاب سے خارج ہونے کی مختلف کیٹیگریز بنائی ہیں۔  ان کیٹیگریز میں ایسے تمام کیسز شامل ہیں جن پر ایف بی آر کا انٹیلی جنس اور انوسٹی گیشن ونگ تحقیقات کر رہا ہے۔ ایسے تمام کیسز بھی خارج کر دیئے جائیں گے جن میں تنخواہ اور پنشن پر ٹیکس لاگو آمدنی ٹیکس عائد آمدنی کے 50 فیصد سے تجاوز کر جائے سوائے ان کیسز پر جہاں آمدنی کاروبار کے ذریعے آئے۔ کمپنیوں کے ڈائریکٹرز اس اخراج کے لئے کوالیفائی نہیں کرتے ۔ وہ تمام کیسز جن میں تمام آمدنی حتمی ٹیکس رجیم کے دائرہ کار میں آئے اور وہ تمام کیسز جنہوں نے 2018 اور 2019ایمنسٹی سکیم کے تحت اثاثے ظاہر کر دیئے ہیں وہ بھی آڈٹ کے انتخاب سے خارج کر دیئے ہیں ۔ وفاقی ، صوبائی اور مقامی حکومتوں کے ادارے بھی  آڈٹ کے لیئے خارج کر دیئے گئے ہیں۔

قانون کے مطابق آڈٹ کے لئے متعین پیرامیٹرز خفیہ رکھے جایئں گے ۔ آڈٹ پالیسی 2019 کو ایف بی آر کی ویب سائٹ www.fbr.gov.pkپر اپلوڈ کر دیا گیا ہے۔
